Terms of Service

Please read these Terms of Service carefully before placing an order. By submitting an order through cast.parta.app you agree to be bound by these Terms in full. If you do not agree, do not place an order.

Section 1

Parties and service description

Parta Cast is a parametric silicone mould kit production service operated by ae Aeonian Engineering Limited ("AEL"), a company incorporated in Hong Kong. WIDE di D. Papa ("WIDE"), an Italian sole trader active since 1997 and registered in Sant'Antimo (NA), Italy, acts as the European Union operational and compliance partner for purposes of EU law, including the General Data Protection Regulation.

The service allows customers to upload a three-dimensional mesh file, configure mould parameters, and receive a physical kit consisting of FDM-printed shield halves, resin master halves, pre-dosed platinum-cure silicone, and an assembly guide ("the Kit"). The Kit is produced on demand and shipped to the address provided at checkout.

Section 2

Order process and contract formation

An order is placed when the customer completes the configurator, provides valid contact and shipping details, accepts these Terms, and submits the order form. AEL will confirm the order by issuing an order reference number. The contract between AEL and the customer is formed at the moment the order confirmation is issued, not at the moment of submission.

AEL reserves the right to decline any order at its sole discretion, including where the uploaded mesh cannot be processed, the shipping destination is not serviceable, or payment is not received within the agreed timeframe.

Section 3

Payment

All prices are quoted in Euros (EUR) and exclude VAT and shipping. Payment is due in full prior to production. AEL will issue a payment request following order confirmation. Production commences only upon receipt of cleared funds. AEL accepts bank transfer and other methods as stated in the payment request.

VAT is applied at checkout in accordance with applicable law. For EU customers, VAT is calculated based on the customer's country of residence or establishment. For B2B customers with a valid EU VAT number, the reverse charge mechanism may apply where permitted.

Section 4

Production and delivery

Production lead time is 3 to 5 business days from receipt of cleared payment, subject to queue position. Orders are fulfilled in the sequence in which payment is confirmed (first-in, first-out). AEL will notify the customer when the order ships and provide a tracking number where available.

Shipping is via DHL Express unless otherwise agreed. Estimated transit times depend on destination and are provided by the carrier. AEL is not responsible for delays caused by the carrier, customs, or events outside AEL's reasonable control.

Risk of loss and title to the Kit pass to the customer upon handover to the carrier. Import duties, customs fees, and local taxes are the sole responsibility of the customer.

Section 5

Intellectual property

Customer mesh file

The customer retains all intellectual property rights in the mesh file uploaded to the service. AEL uses the file exclusively to generate mould geometry for the purpose of producing the Kit ordered by the customer. AEL does not claim any rights in the customer's mesh file or in the physical objects represented by it.

AEL mould generation technology

The parametric mould generation algorithm, shield geometry, wave profile, and all associated software are the proprietary intellectual property of AEL. The generated shield and master STL files are AEL's work product. They are produced for the sole purpose of manufacturing the Kit and are not transferred to the customer. The customer receives the physical Kit only.

Parta Cast brand and platform

The Parta Cast name, logo, and platform are owned by AEL. Nothing in these Terms grants the customer any licence to use AEL's trademarks or brand assets.

Section 6

File retention and deletion

AEL retains uploaded mesh files and generated production files on its servers only for the duration necessary to produce and ship the Kit. Files are deleted following confirmed delivery or, at the latest, 30 days after the order ships. Order metadata (reference number, configuration parameters, quote, contact details) is retained for accounting and legal compliance purposes in accordance with the Privacy Policy.

Section 7

Customer responsibilities

The customer is solely responsible for:

  • Ensuring they hold all necessary rights to upload and use the mesh file.
  • Selecting the appropriate shore hardness and mould parameters for their application.
  • The choice of casting material and all associated safety, handling, and regulatory obligations.
  • Completing the injection holes and vents to suit their specific casting method and material viscosity.
  • The end use of any castings produced using the Kit.

AEL supplies mould geometry and a physical kit. AEL does not supply casting materials, process supervision, or technical consultancy on casting chemistry.

Section 8

Returns, refunds, and defective items

All Kits are produced on a custom, made-to-order basis from the customer's specific mesh file and configuration. Accordingly, Kits are non-refundable except where they deviate materially from the confirmed specification.

If a Kit is defective or materially non-conforming, the customer must notify AEL within 14 days of receipt, providing photographs and a description of the defect. AEL will, at its option, replace the affected components or issue a credit note. AEL's liability is limited to the value of the affected Kit.

EU consumers retain all statutory rights under applicable EU consumer protection law where those rights cannot be excluded by contract.

Section 9

Limitation of liability

To the fullest extent permitted by applicable law, AEL's total liability to the customer under or in connection with any order shall not exceed the amount paid by the customer for that order.

AEL shall not be liable for any indirect, consequential, special, or incidental loss or damage, including loss of profits, loss of business, or loss of data, arising from the use of the Kit or the service.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

Section 10

Governing law and jurisdiction

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR, except where applicable mandatory consumer protection law in the customer's country of residence provides otherwise.

For EU consumers, nothing in these Terms affects any rights available under the law of the EU member state in which the consumer is resident.

Section 11

Changes to these Terms

AEL may update these Terms from time to time. The version in effect at the time of order confirmation governs that order. Material changes will be communicated by updating the effective date above. Continued use of the service after an updated version is published constitutes acceptance of the updated Terms.
